1. Agreement
These Terms of Service (the “Terms”) are a binding agreement between you (or the organization you represent) and DotCamp LLC ( “OptimizeCamp”, “we”, “us”), which operates the OptimizeCamp platform. If you use the service on behalf of an organization, you represent that you are authorized to bind it.
2. Eligibility and accounts
You must be at least 18 years old to use OptimizeCamp. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Seats are per-person; do not share a single login across multiple people.
3. The service
OptimizeCamp measures how AI answer engines talk about your brand, helps you optimize and create content, and re-measures to show impact. We may add, change, or remove features over time. We aim for high availability but do not guarantee uninterrupted service.
4. Subscriptions and billing
- Accounts choose a plan and are billed up front through Freemius. If your subscription lapses or is cancelled, your workspace becomes read-only until an active plan is restored; your data is retained.
- Paid plans are billed in advance on a recurring basis (monthly or annual) through Freemius, our merchant of record, and renew automatically until cancelled. Your purchase is made from Freemius, which charges your payment method for each term on our behalf and issues your invoices.
- Applicable taxes (such as VAT or sales tax) are calculated and collected at checkout by Freemius where required. We may change prices with reasonable advance notice, effective on your next renewal.
- If a charge fails, we may suspend or make your workspace read-only until payment is resolved.
5. Refunds
Paid plans are covered by our Refund Policy, which is incorporated into these Terms.
6. Acceptable use
You agree not to:
- use the service for anything unlawful, infringing, or harmful;
- resell, sublicense, or provide the service to third parties except as expressly permitted by your plan;
- reverse engineer, scrape, or attempt to circumvent quotas, rate limits, or security controls;
- upload content you do not have the right to use, or connect a WordPress site or other property you do not control or are not authorized to manage;
- violate the terms of the third-party platforms the service interacts with, including AI providers and WordPress.
7. Your content
You retain all rights to the content you provide or connect (“Your Content”). You grant us a worldwide, non-exclusive license to host, process, and transmit Your Content solely to provide and improve the service as described in our Privacy Policy. You represent that you have the rights necessary to grant this license.
8. AI-generated output
OptimizeCamp uses AI to measure visibility and to generate briefs and drafts. AI output can be inaccurate or incomplete and is provided for your review. You are responsible for reviewing, editing, and approving any generated content before you publish it — generated articles reach your CMS only as drafts. We do not guarantee any particular result, including any improvement in how AI systems mention, cite, or rank your brand; those systems are operated by third parties and are outside our control.
9. Third-party services
The service integrates with third parties such as AI platforms, WordPress, and Freemius (our merchant of record for purchases). Your use of those services is governed by their terms, and we are not responsible for their availability, changes, or acts.
10. Intellectual property
The service, including its software, design, and content (excluding Your Content), is owned by DotCamp LLC and protected by law. If you send us feedback, you grant us a perpetual, royalty-free license to use it to improve the service.
11. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, DotCamp LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold DotCamp LLC harmless from claims, damages, and expenses arising from Your Content, your use of the service, or your breach of these Terms.
14. Termination
You may cancel at any time. We may suspend or terminate your access if you breach these Terms or to protect the service. On termination, your right to use the service ends; data handling follows our Privacy Policy.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute not otherwise resolved.
16. Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide notice; your continued use after the effective date means you accept the updated Terms.
